Hold Harmless Agreement: By using the products, services, or equipment provided by Adaptive Mobility LLC, you acknowledge and agree to hold us harmless from any liability, claims, actions, or expenses (including legal fees) arising from any injury, including but not limited to personal injury, disability, or death, that may occur while using our products, services, or equipment.
You understand and accept the inherent risks associated with construction-related activities and agree that Adaptive Mobility LLC, its employees, agents, and affiliates shall not be held responsible for any injuries sustained during the use of our products, services, or equipment. It is your responsibility to use our products, services, and equipment in a safe and responsible manner. You agree to indemnify and defend Adaptive Mobility LLC against any claims or actions brought by third parties arising out of your use of our products, services, or equipment.
This hold harmless agreement extends to all users, customers, and third parties who may be affected by the use of our products, services, or equipment.

Returns and Refunds: Returns or exchanges must be made within 7 days of purchase and exclude installed equipment, custom/special order items and bath/hygiene products. Job site photos may be used for marketing purposes. Prescription must be provided upon job completion in order to waive sales tax in Colorado.
Product and Labor Warranty: Thank you for purchasing your equipment from Adaptive Mobility, LLC. Each piece of equipment is covered by a specific manufacturer’s warranty, see the manufacturer’s warranty for details. It is important to note that batteries are not covered under any manufacturer’s warranty. It is imperative that batteries be charged properly and maintained regularly.
Adaptive Mobility, LLC is proud to offer a one-year labor warranty. The equipment is warranted to the original purchaser and installed equipment is warranted only to the original place of installation. Equipment is warranted for defects in materials or workmanship, under normal use and maintenance for the period of 12 months from the date of installation, labor only.
If any such defects should be found within the applicable warranty period, Adaptive Mobility, LLC shall repair under the service policy and make all reasonable efforts to replace the defective parts under the applicable manufacturer’s warranty. This warranty shall not apply to:
- Any defects caused or repair required by abusive operation, neglect, accident, or other than that for which the equipment was intended.
- Any damages caused by fire, animals, vandalism, chemicals, or acts of nature.
- Any devices or peripherals that have been tampered with, repaired, or adjusted by any party other than Adaptive Mobility, LLC or their agents.
- Any cosmetic damage to the surface or exterior that has been defaced or caused by normal wear and tear.
- Construction or installation supplied by others were the consequences of faulty construction or installation.
This warranty constitutes the entire and expressed warranty granted by Adaptive Mobility, LLC. To the extent the law permits, Adaptive Mobility, LLC disclaim any and all liability for direct or indirect damages or losses for any incidental, special, or consequential damages or loss in profits resulting from lack of service relating to the device including the loss of time or use of this device. Correlation of defects, and the manner in the of time described within, constitute complete fulfillment of all obligations and responsibilities of Adaptive Mobility, LLC to the purchaser with respect to the device and shall constitute full satisfaction of all claims, whether based on contract, negligence, strict liability or otherwise. After the warranty period expires, Adaptive Mobility, LLC offers no service guarantees and reserves the right to refuse service at any time. Photos of your project may be used for marketing purposes.
I recognize that any piece of adaptive equipment may experience mechanical problems and that I am ultimately responsible for the care and maintenance of my equipment. Adaptive Mobility, LLC makes every effort to respond to service and warranty issues in a timely manner but is not available 24 hours a day. Adaptive Mobility, LLC recommends a backup plan for any piece of equipment that one uses for daily living or otherwise.
Unauthorized Use: Unauthorized use of our website and computer systems, including but not limited to unauthorized entry into our computer systems, misuse of passwords, or misuse of any information posted to this site, is strictly prohibited. Any attempted unlawful use may subject you to liability for damages or criminal prosecution.
Privacy Policy, Information Security and Online Fraud: Please review our Privacy Policy and information about the types of information we gather when people use our website, and suggestions for protecting the security of your personal information online. Please contact us immediately if you believe that you have been a victim of fraud or identity theft involving an account with us.
Other Service Agreements: If you are an Adaptive Mobility customer and access your account information or conduct transactions through this site, the terms and conditions of the particular service supplement these website terms and conditions. If these website terms and conditions conflict with the agreement or disclosures governing the particular service you receive from us, the terms, conditions and disclosures governing that particular service will control.
Jurisdiction; Entire Agreement: These website terms and conditions will be governed by and interpreted under the laws of the State of Colorado, USA, and other applicable federal laws.
